Terms of Service
These terms are an agreement between your business ("you") and Destiny Marketing Group ("we", "us"), which provides Destiny OS: a dashboard and a team of AI agents that research, write, plan and coordinate work for your business. By signing in or adding a payment card you accept these terms on behalf of your business.
1. The service
Destiny OS gives your business its own AI team, its own data and its own dashboard. Your data is kept separate from every other business on the platform. The team works during the hours you set and on the tasks you and your staff give it.
2. You stay in control
- Nothing that leaves your business — emails, offers, published posts, spending, or commitments — is sent or done without approval in your dashboard, unless you choose to let a teammate approve a specific kind of item after you have approved enough of them yourself.
- AI can make mistakes. Review what you approve. You are responsible for the content you approve and for how you use the service, including following the laws that apply to your outreach and marketing (for example CAN-SPAM, TCPA, and privacy laws).
- Don't use Destiny OS to send spam, contact people from bought or scraped lists, mislead anyone, or break any law or platform rule.
3. Fees and billing
- You pay the monthly platform fee shown on your Costs tab, plus AI team usage (our AI provider cost plus the markup shown to you) and any other charges listed on your Costs tab.
- We bill on the 1st of each month for the month before, through Stripe. With a card on file the invoice is charged automatically; otherwise it is emailed with a payment link due in 7 days.
- If a payment fails, your team is put on hold until the invoice is paid. Your data is kept.
- Each business has a monthly AI budget. When it is reached the team rests until the next month or until the budget is raised.
- Fees are not refundable for past months, except where the law requires it.
4. Your data
You own your business information, records, content and messages. You give us permission to store and process them only to run the service for you. Connected account passwords and keys are stored encrypted and are never shown back. See the Privacy Policy.
5. Connected accounts
When you connect an email account or a Facebook Page, you authorize Destiny OS to send or publish through it on your behalf, only for items you (or a teammate you allowed) approved. You can disconnect at any time from the Connections tab.
6. Cancelling
You can cancel at any time by emailing us. Service ends at the end of the current month and you receive a final invoice for that month. On request we will export or delete your data within 30 days.
7. Availability and changes
We work to keep Destiny OS running but don't guarantee it will always be available or error-free. We may improve or change features. We will give you at least 30 days' notice of any price change.
8. Limits of liability
The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or the results of content you approved, and our total liability is limited to the fees you paid us in the three months before the claim.
9. Law
These terms are governed by the laws of the State of Delaware, USA.
